1. Services
    1. The Suntec+ Platform provides a platform which allows you to place orders for food and beverages and other goods and services (“Products”) from selected merchants (“Merchants”), such orders may be delivered to you or available for pick up.
    2. QIPL merely provides the platform and does not own, sell, resell and does not act on behalf of the Merchants, we do not control or exercise oversight over the Merchants and their Products. You understand that any order that you place shall be subject to the Products’ availability and location serviceability of the Merchants and any delivery services which they may engage.
    3. The availability, prices of and the descriptions of the Products set out on the Suntec+ Platform are determined solely by the Merchants and are listed for information only. You understand that:
      1. the availability, prices and description of the Products may be outdated, incomplete, or inaccurate. In such an event, Merchants may choose not to provide the relevant Product at the price or description stated; and
      2. we are not obligated to provide further information (e.g. ingredient / allergen information, available promotions or vouchers, or Merchants’ terms and conditions) and in the event that further clarification is required, please contact the relevant Merchant directly; and
      3. we are not responsible for any advertising or marketing information of Merchants posted on the Platform.
    4. Merchants are responsible for the preparation, condition and quality of the Products, and the delivery of the Products. QIPL shall not be liable for any loss or damage arising from your contractual relationship with the Merchants. Any cancellation, compensation or refund / returns requests arising from the Products (e.g. any alleged defects) will be referred directly to the relevant Merchant.
    5. Merchants may choose to offer certain regulated Products on the Platform, such as alcohol, tobacco, second-hand goods, or pharmaceuticals (“Restricted Goods”). As we do not vet the Products which the Merchants advertise and offer, we are not responsible for the sale of such Restricted Goods. We hereby expressly disclaim any representations or warranties that the Products, including the Restricted Goods, will be non-infringing of Applicable Laws or any third party rights. It is the responsibility of the Merchants to fulfil any regulatory obligations with respect to the advertising, offering or sale of any such Restricted Goods. Nonetheless, we reserve the right to:
      1. require any information or documentation from you, e.g. any valid proof of identity / verification of age (you must be at least eighteen (18) years old at the time of sale and delivery), to fulfil any requirements imposed by Applicable Laws, and to cancel the transaction or delivery if you are unable to do so; and
      2. otherwise cancel the transaction or delivery if we suspect, for any reason, that any such offering or sale would be in contravention of Applicable Laws.
  2. Placement of Orders
    1. You represent and warrant that any personal data (including address, contact details) that you provide is current, accurate and complete. QIPL, the Merchants and/or their delivery services provider shall not be liable for any late or non-delivery of Products by reason of such erroneous details.
    2. We reserve the right to not process the order and/or restrict or terminate your access to our Services or the App, in our sole discretion, in the event of false or erroneous personal information, payment details, suspected fraud or lack of authorisation, or any suspected contravention of any Applicable Laws.
    3. We are entitled to treat any order and delivery bookings placed on the Platform from your accounts as coming from or authorised by you. Upon receiving a confirmation notice, you shall not be entitled to cancel your order once you have received a confirmation. If you cancel your order subsequently, you are liable to pay the order and any delivery fee in full.
    4. Upon receiving your order, the Merchants and/or their delivery services provider may contact you through the contact details which you have provided, to confirm order details (including any special instructions, where applicable), make delivery arrangements, and/or inform you of the unavailability of the product or any change in price, where applicable. The transaction details, arrangements made, and any communications would be between you and the Merchants, with no involvement from us.
    5. We and/or the Merchant may not be able to process your order or deliver the Products to you as requested, due to the following:
      1. the listing and other information on the Platform is outdated and the Products are out of stock or otherwise unavailable;
      2. there is a lack of information, direction or authorisation from you at the time of delivery;
      3. you are unavailable on the phone at the time of the call for confirming the order or otherwise uncontactable;
      4. (only for Suntec+ Eats services) at the relevant timing arranged, you are not present or do not show up at the designated delivery or pick up location within fifteen (15) minutes to collect the takeaway ordered, or you are unreachable physically or uncontactable; or
      5. the delivery or pickup location or the circumstances of the same is not safe, secure or otherwise unsuitable.

In the event that any of the foregoing occurs, we and/or the Merchants reserve the right to cancel the order without any refund or compensation to you.

    1. As Merchants are responsible for the delivery of orders, you shall contact the relevant Merchant directly in the event of issues such as non-delivery or delays in your delivery. We shall not be responsible in any way for orders that are delivered by Merchants, and any cancellation, compensation or refund / returns requests will be referred directly to the relevant Merchant.
  1. Payment
    1. Prices set out on the Platform are inclusive of GST, but exclusive of any other charges (including for instance, delivery charges, which may vary depending on distance, and the mode of delivery selected). Before confirmation of the order, the Platform will provide a breakdown of the price which will include any additional charges (e.g. delivery, minimum order charges).
    2. As the prices of the Products are provided to us by the Merchants, whilst we endeavour to ensure that they are accurate and current, this may not be the case. The prices provided are subject to change at any time and may vary from the prices of the Products if purchased directly from the relevant Merchant.
    3. You can choose to pay for an order using any of the payment methods on the Suntec+ Platform QIPL reserves the right to offer additional payment methods and/or remove existing payment methods at any time in its sole discretion.
    4. The method of payment chosen may involve the processing of such payment by banks or third-party service providers, we are not liable for any failure or other issues that may arise in such payment processing.
